State of Florida v. Casey Anthony

    1. Title of Case

State of Florida v. Casey Marie Anthony

This was a felony criminal case prosecuted by the State of Florida in 2011.

    2. Court of Original Jurisdiction

    Orange County Circuit Court

    • State trial court of general jurisdiction
    • Handles felony criminal cases
    • Located in Orlando, Florida

In the 13th edition of Americas Courts and the Criminal Justice System, David W. Neubauer and Henry F. Fradella explain that felony trials begin in state trial courts like this one, where juries determine guilt.

    3. Trial Judge

    Belvin Perry Jr.

    • Presided over the trial
    • Ruled on objections
    • Determined admissibility of evidence
    • Instructed the jury on the law
    • Imposed the sentence

    4. Prosecutor

    Linda Drane Burdick

    • Represented the State of Florida
    • Had the burden of proving guilt beyond a reasonable doubt
    • Presented forensic and circumstantial evidence

    5. Defense Attorney

    Jose Baez

    • Lead defense counsel
    • Argued that the death was accidental
    • Claimed there was insufficient evidence to prove murder
    • Focused on creating reasonable doubt

    6. Defendant

    Casey Anthony

    • Mother of the victim
    • Arrested in 2008
    • Pleaded not guilty
    • Exercised her constitutional right to trial

    7. Victim

    Caylee Anthony

    • 2-year-old daughter of Casey Anthony
    • Reported missing in July 2008
    • Remains discovered months later

    8. Witnesses

    The trial included:

    • Forensic experts
    • Law enforcement officers
    • Family members
    • Computer forensic analysts

The prosecution relied heavily on forensic and circumstantial evidence, including internet searches and decomposition evidence.

    9. Original Charges Filed Against the Defendant

    Casey Anthony was charged with:

    • First-degree murder
    • Aggravated child abuse
    • Aggravated manslaughter of a child
    • Four counts of providing false information to law enforcement (felony charges)

    10. Did the Case Go to Trial or Plea Bargain?

The case went to a full jury trial.

    There was no plea bargain.

    Trial Process Included:

    • Jury selection (voir dire)
    • Opening statements
    • Presentation of prosecution evidence
    • Defense presentation
    • Closing arguments
    • Jury deliberation

Because of heavy media coverage, jurors were selected carefully to avoid bias.

    11. What Was the Defendant Officially Convicted Of?

    In July 2011:

    • NOT guilty of first-degree murder
    • NOT guilty of aggravated child abuse
    • NOT guilty of aggravated manslaughter
    • GUILTY of four counts of providing false information to law enforcement

    These were felony convictions.

    12. What Sentence Was Imposed?

Judge Belvin Perry sentenced her to:

    • 4 years in jail
    • $1,000 fine per false information count
    • Credit for time already served

Because she had already been in jail awaiting trial, she was released shortly after sentencing.

Was the Sentence Fair? (Analysis Section for Slide)

Legally, the sentence matched the convictions.

However, many members of the public believed the sentence was not severe enough because she was acquitted of murder.

From a legal standpoint, the judge must sentence based only on the crimes of conviction not public opinion.

    13. Was There an Appeal Filed?

    Yes.

    Appeal filed in the:

Florida Fifth District Court of Appeal

    14. Reasons for the Appeal

    The defense challenged:

    • The validity of some false statement counts
    • Argued certain charges were duplicative

    15. Outcome of the Appeal

    The appellate court:

    • Vacated two of the false statement convictions
    • Upheld the remaining two convictions

The case did not result in a retrial.

The appellate court did not overturn the entire conviction.

  • Annotated Bibliography

In order to get you started on your final research paper, you will complete an annotated bibliography. If you use AI, you will fail the assignment. Completing an annotated bibliography will serve at least three purposes:

    • First, this assignment will help you to figure out what topic you want to focus on in your final theory paper. By collecting your scholarly literature and writing your summaries, you will become more familiar with the research conducted, thereby helping you to write the literature review in your final paper. You want the topic to be narrow in focus.
    • Second, completing this assignment will allow you to begin constructing the reference page for your final theory paper. When completing this assignment, you will want to list each citation in ASA. When you are putting together your final theory paper, you can use the reference list constructed in the annotated bibliography assignment. This will save you time and ensure that you earn all possible points. Also, you will want to list your citations in alphabetical order as per ASA guidelines.
    • Here are the specifics:
    • To begin your exploration of the topic, provide an annotated bibliography of 10 scholarly research articles on your topic. You should write up to no less than 100 words (double-spaced) for each article summary. You can certainly write more. You are NOT cut/pasting directly from the article. It is your summary regarding the important details about the research that you find essential. For each citation, list your citation in ASA. Right below that, provide your summary.
    • Each article in your annotated bibliography is worth 10 points for a total of 100 possible points. You will also be graded on spelling, grammar and sentence structure (10pts) = 110 total points.
    • Please list your citations in ASA. If you do not, I will take up to 3 points off per article. If you list them correctly the first time, it will make less work for you when submitting your final theory research paper.
    • Also, when you write the actual summary of each citation, practice using ASA in text. Make use of your ASA guide and ask questions if you have them. Your summaries should be no less than 100 words, but you can provide more dialog as you see appropriate.
    • You will use the annotated bibliography to construct your literature review in the final research proposal due at the end of the semester. This means that you will not cut/paste the annotated bibliography into the final paper. If you do, you will not earn points in the final paper proposal for your literature review section. The summaries are needed to help you construct your final review of the literature. Let me know if you have any questions.

  • Juvenile probation and parole: Policy and Program Reform

You should write a 1 page introduction that should briefly describe the area of policy, briefly describes the problems and the briefly describe how you propose to address both policy successes and failures.

You should write a 3 page literature review which will discuss the various policy programs including successes and failures.

In about 3 pages you should outline how you would develop a new policy program

In 3 pages you should give a plan of how you both plan to implement the program and then also evaluate the program.

All this should relate to the topic below!!!!

    Final Project Topic

The program that I would like to evaluate for the final project would be the Juvenile

Probation and Parole program. This program is a court-imposed intervention for youthful

offenders that is specifically designed to meet the needs of juveniles in their rehabilitation, while

also having the structural support of the justice system. The Juvenile Probation and Parole

program is an alternative to incarceration. This allows the youth to remain within the community

but be under the supervision of a court order. The primary goal of this program is to rehabilitate,

facilitate positive behavioral change, and support youth as they prepare to reintegrate back into

society. I feel that this is an important topic to evaluate because programs such play a role in

shaping youth offenders before they become adult offenders. Evaluation of this program is

important to ensure youth offenders are being treated fairly and to identify any racial, societal, or

    gender-influenced disparities

  • Stop and Frisk

Week 5 Discussion: Stop and Frisk Upon completing this week’s reading and research on “Stop and Frisk” please detail your perception of this practice. If you were developing policy for your agency would you encourage officers to engage in this strategy to reduce crime and the fear of crime? Do you believe race plays a role in persons who may be subjected to a “stop and frisk”? Each week your class discussion will consist of an initial post and three peer responses. Answer the question thoroughly, typically (175-300 words) in total.

    Case Study

    Meet Mark.

Mark is excited to begin training as an emergency department nurse. On his first day, the nurse training him makes multiple negative remarks about the physician on duty. Dont ever make a suggestion, or shell ream you out. You have to walk on eggshells around her. Later, another nurse is showing Mark where the supplies are kept. She tells him, If you cant find things, dont call Central Supply because theyll get on your back about wasting resources. Its better to keep a few key things like IV start kits hidden so you can grab them when you need them.

Toward the end of his shift, a nurse assistant tells Mark a patient is vomiting violently in one of the examination rooms. However, Mark walks in to find the patient sitting up smiling and only a small amount of emesis in the basin. He hears muffled laughter coming from the hallway. Later in the shift, the nurse who is training Mark comments, Hope you dont mind a little kidding around. This job can get to you, and its good to laugh when we can.

The remainder of his training is free of other incidents and, overall, goes well.

    Case Study Questions

    1. What kind of culture best describes this department based on the scenario? Support your reasoning.
    2. What appears to be the implicit rules of the emergency department of this organization?
    3. Mark used respectful communication to optimize his relationships with the Central Supply staff, the nurse assistants, and the nurse training him. What barriers might exist in building respectful dialogue?
    4. In what ways are you like Mark? In what ways are you different?

    Submission and Assessment Guidelines

    • Submit your Microsoft Word document with the questions clearly listed and answered. All of the questions MUST be answered in your document.
    • It is expected that your answers are free of grammatical errors and in complete sentences, where appropriate.
