  • LEG100 Assignment

Part A: You will create a personal contract to achieve a specific goal in your life (e.g., graduating from college, improving fitness, getting a promotion, or any other personal objective). This contract will demonstrate your understanding of key legal contract components and their application in real life. Follow the outlined steps below to complete the assignment.

    Use the template to:

    1. Write a brief explanation of your personal goal and the purpose of the contract.
    2. Define the parties of the contract.
    3. Explain the offer of the contract.
    4. Describe the acceptance of the contract.
    5. Determine what is being exchanged in the contract.
    6. Provide the contract details, including the capacity and legality.
    7. Collect the signatures of the agreement.
    8. Write a brief reflection (150200 words) on how creating this contract helped you understand the elements of a legal contract and its real-life applications.

Part B: Van Halen had a tour rider in their contract who demanded M&Ms pre-concert. A tour rider is included in a contract and is a list of things demanded by the stars (types of drinks, snacks, etc.). Van Halen wanted M&Ms with the brown ones removed. The presence of a single brown M&M was grounds for Van Halen to cancel a scheduled appearance. Van Halen had a very large stage production that not every venue could accommodate. If the brown M&Ms were not removed for the band, then they would know that the contract had not been read and would know to do extra safety checks on stage to be sure everything was properly set up. This turned out to be an ingenious way to determine if someone read the contract and ensured the safety of performers and spectators.

    Use the template below:

    1. Define the parties of the contract.
    2. Explain the offer of the contract.
    3. Describe the acceptance of the contract.
    4. Determine what is being exchanged in the contract.
    5. Provide the contract details, including the capacity and legality.
    6. Collect the signatures of the agreement.
    7. Write a brief reflection (150200 words) on how creating this contract helped you understand the elements of a legal contract and its real-life applications.

  • OSHA Compliance and Safety Regulations.

Our client, Ally’s lotion manufacturing business (200 employees), thrives. The company earned 8 million dollars last year. However, in the last month, four workers at her manufacturing plant have been seriously injured while performing work duties. The injuries appear to be caused by ventilation issues, the use of hazardous materials (including acetylene and flammable liquids), and the lack of safety equipment.

Ally is concerned that the Department of Labor and the Occupational Safety and Health Administration (OSHA) are going to come after her and impose fines or shut down her business.

A law partner has asked that you research the following and prepare a letter to the client (see page 25 of our APUS Legal Studies Writing Guide) addressing the following:

    1. What exactly does OSHA do, and where does that agency fit within our three branches of government?
    2. What is the Occupational and Safety Health Act (provide the citation)?
    3. What are the regulations regarding workplace safety?
    4. What action can OSHA take against Ally’s company?
    5. What type of judge would hear Ally’s complaints about OSHA’s safety assessment and requirements of Ally’s company?
    6. How are OSHA rules created, and how does that compare to the legislative process?
    7. You may want to review actions taken against other companies: .
    8. What action should she take? Can she terminate those workers?

Note: In each week’s discussion board contains multiple issues. As such, your initial post does not have to address all of the issues. Rather, your follow-up posts to your classmates and professor can tackle the issues you did not examine in your first post.

I have attached instructions on how the essay should be organized and written, as well as an outline of the content I want included.

Please follow the provided structure closely and use my outline as the foundation for the narrative. The essay should be reflective, mature, and cohesive, with smooth transitions and a clear progression of growth.

Be sure to emphasize that I worked multiple jobs starting at sixteen and continued working while completing both my Bachelors and Masters degrees. I later built and managed my own business while still pursuing graduate education. This balance of work, academics, and entrepreneurship is important to highlight.

The Cuba story should serve as the opening foundation, and the conclusion should clearly explain why law is the natural continuation of my life experiences and values.

  • Conflict Resolution in Work Space

Your challenge for your final research paper in this course is to present conflicting issues in our criminal justice system and ways how you can minimize/mitigate these issues. This conflict can be attributed to personnel, policies, procedures, training, etc. The essay must be written in a creative and meaningful (thoughtful) way that is demonstrative of critical thinking.

This 5- to 7-page (1000 to 1200 words) research paper should be formatted in an organized way. See the attachment for complete assignment instructions, outline suggestions, and rubric details.

    Paper Format

    • You do not need subheadings or abstracts for these papers.
    • Use the APA Word Template and personalize it for this assignment.
    • Your paper should be double-spaced in Times New Roman 12-point font and with 1-inch margins all the way around your paper.
    • You should have in-text citations in every paragraph of your paper to align with the materials, concept(s), and definitions you discuss, even though your discussion was in your own words. As you are discussing materials from other sources, even though you are discussing these materials in your own words you must still properly cite sources with in-text citations and references in APA format.
    • Be sure to write in your own words as much as possible. Avoid using direct quotes (write in your own words), and properly cite your textbook (for the concepts), as well as any other sources you use.
    • Anything not in your own words (taken word-for-word from other sources) must be in quotation marks (” “) or you are plagiarizing. You should write in your own words as much as possible, summarizing and paraphrasing what you read/hear in this course, to minimize your similarity to other sources. Even writing in your own words, you must properly cite all sources (textbook, videos, etc.) for the information you are discussing, or you are plagiarizing.
    • Do not use first person (I, me, we, us, etc.) or subjective/opinion statements in academic or professional writing, including these writing assignments. This is not an opinion paper.
    • If the information you are discussing in a paragraph is all from one source (such as your textbook), cite that source with in-text citations at the beginning and the end of the paragraph. Also cite the source following any direct quotes.

    Requirements: 5 pages

  • Fourth Amendment reasonableness approaches and precedent

Respond in a short answer format but cite your sources. The fourth amendment focuses on the reasonableness of actions regarding searches and seizures. Assessing reasonableness and what is unreasonable can be arbitrary. The textbook discusses two approaches that are used to determine reasonableness. What are these two approaches and explain them? Identify at least one case that has set a precedent regarding what is reasonable or unreasonable, indicate if you agree or disagree and why.

    (1) Should the US develop a national law addressing privacy akin to GDPR in the EU, particularly in the technology space, or continue to address the issues through sector by sector national legislation (e.g, Health Care, Education, etc.), coupled with FTC Act enforcement, and individual state privacy legislation?

I want to argue that the US should, but acknowledge other points.

follow the sample outline, the case itself, and the instructions, to write a complete script for a 13minutes presentation.

The best place to begin is by reviewing the facts found in the record, including the arresting officers hearing testimony, and the tip received on the tip line. See which facts were corroborated, and see which facts you might be able to corroborate on your own.

Then, when you begin researching, start by reviewing the cases cited in the district courts memorandum denying the motion to suppress. Remember that you are looking for relevant Supreme Court cases, First Circuit cases, and district court cases within the First Circuit (if they are particularly useful on the facts). You want to find cases that identify and discuss the various factors courts consider in assessing probable cause based on information supplied by an anonymous tipster.
