  • Moot Court Case Paper

    It is imperative that you follow the instructions for the briefs and opinions. Papers must be

    between 5-7 pages in length, not including the title page. The papers should include a title page,

    which contains the name of the case, the students name, role in the case, the instructors name, the

    course number and title of the course, and the date the assignment was completed.

    Each paper should have the following subheads: Facts, including the prior proceedings, Issues(s), Analysis, and Conclusion. The papers must be double-spaced, contain page numbers, and use a size 12 font.

    Each requires a ruling from the perspective of a Conservative, Republican Justice (my role) on the following cases. I am against allowing males to participate in womens sports and vice versa. I am also against allowing transgender individuals to participate in sports of the opposite sex (transgender males should not be able to participate in female sports, and transgender females should not be allowed to participate in male sports). This is mainly based on the biological makeup and advantages that males have over females in growth, development, and strength. My opinion must be supported by previous court cases to justify my ruling.

In response, Sadie pushed Ally away. Ally lost her balance and fell into Willard Smithton. Willard then lost his balance, fell face-first onto the tile floor, hit his head, and died at the scene.

    Terrified about what occurred, Sadie fled the scene and drove home. While driving home, she hit another car. The driver of the other car was pronounced dead at the scene. When the police caught up with her, they administered a breath test to Sadie, who failed it. She was arrested for driving under the influence.

    Using page 22 of our APUS Legal Studies Writing Guide for the format, write a memo addressing the following:

    1. What crimes can Sadie be charged under the penal code in your home state? Cite the law. If Sadie was interested in pursuing a plea deal, what type of plea deal would you discuss with the prosecutor?
    2. Sadie was advised there would be an arraignment. What is that, and what, if anything, does Sadie need to do?
    3. Explain why you think the prosecutor in your home state would pursue this case by filing information or by an indictment.
    4. Sadie was charged with several crimes, given the facts presented. Assuming your firm can represent Sadie, your firm has learned from a reliable source that the prosecutor may have information related to a faulty breathalyzer device and that a witness stated that someone else may have pushed Willard. Is the prosecution required to provide this information (about the witness and breathalyzer test) to Sadie’s attorney? What is the Brady rule, and what would you argue on behalf of Sadie?
    5. Now assume that Sadie does not have a great deal of money. She cannot hire an expensive attorney. Explain what access to justice issues are related to this sort of factual scenario and make suggestions about how to reduce the legal burdens associated with such problems.

    Students will be divided into groups, provided with a fact scenario, and asked to use Anishinaabe stories, their understanding of Anishinaabe constitutional order, and talking circle protocols to identify legal issues, apply legal principles, and propose resolutions to the problem.   • Analysis of Bartz v. Anthropic and Kadrey v. Meta

    This assignment is part of a chapter on a piece I am currently working on which analyses the following cases: Bartz v Anthropic / Kadrey v. Meta. The overall piece this case analysis is part of, is my study on the boundaries of fair use when it comes to generative AI. However, your task is to analyse the cases.

    • Start with an introduction (about 200 to 300 words): State clearly that this is a current law analysis (not a normative proposal); briefly introduce the two cases and their relationship (same technology and similar facts); structure of the chapter (analysis Kadrey, analysis Bartz, conclusion).
    • After the introduction you can discuss the two cases separately (integrate Warhol into the discussion of both cases rather than discussing separately). Make sure to structure your discussion of the cases. Start with the factual and procedural background (who are the parties, what do parties claim about fair use, what legal question did the court had decide in relation to fair use); factor-by-factor fair use analysis (purpose and character of the use, nature of the copyrighted works, amount and substantiality, effect on the market); outcome and scope of the holding.
    • You can end the chapter with a conclusion based on what the courts have decided (both courts agree training is transformative; both reject automatic licensing markets; they diverge on market harm and evidentiary thresholds; state clearly what the current law looks like (training on copyrighted works can qualify as fair use but fair use is fact-, model-, and market-specific; market dilution is a legally cognizable theory, but not an easy one to prove); Clarify the evidentiary lesson (plaintiffs must show more than fear or abstraction; defendants cannot rely on transformativeness alone). Finish with a bridge to the next chapter (literature discussion).

    Rosa Parks
    Rosa Parks deliberate decision to test the practice of Jim Crow was the catalyst that triggered the 1955 bus boycott in Montgomery, Alabama. The daughter of James and Leona Edwards McCauley, she grew up in Pine Level, Alabama., and was sent away to a private girls’ school in
    Montgomery at the age of 11. She later met Raymond Parks, a serious young barber with whom she spent many hours discussing the burden and injustice of the racial situation; they married in 1932.

    Mr. Parks was a member of the National Committee to Save the Scottsboro Boys, and she soon joined him in becoming active in the Montgomery chapter of the NAACP, serving as secretary and youth adviser. On December 1, 1955, Rosa Parks refused to give up her seat for a white passenger on a Montgomery bus. Her arrest and the subsequent development of a 381-day bus boycott by tens of thousands heralded a new phase in the civil rights movement.

    The Black community formed the Montgomery Improvement Association, electing as president,
    Martin Luther King, Jr.; Mrs. Parks served for a time on its board of directors. Fired from her job as an assistant tailor in a department store, she stayed in Montgomery until the boycott forced an end to all discriminatory practices on the bus lines. In 1957 she and her husband moved to Detroit, Mich., where in 1965 she took a part-time job as receptionist and administrative aide in the office of Congressman John Conyers. She was the first woman in 1980 to receive the Martin Luther King, Jr., Nonviolent Peace Prize.

    There is a National Committee for the Rosa L. Parks Shrine, organized to commemorate her life by the establishment of a home and library.
