  • Select one of the theories of crime to analyse the real case…

According to the handout instructions, you are required to choose a forensic or psychological theory and apply it to the analysis of a real crime. Although the Jeffrey Dahmer case is provided as an example, you are not allowed to choose this particular case, as it is considered overly studied and frequently used in the literature. Instead, you are required to choose another real crime, which can be either recent or older. However, the research literature (references and empirical findings) used for the analysis must have been published within the last decade (20152025). The paper should be based on 1520+ academic sources (peer-reviewed articles) and be approximately 1500 words long, with a tolerance of 100200 words. Strict adherence to APA guidelines (formatting, in-text citations, bibliography, references, etc.), proper paragraphing, and use of academic vocabulary are required. Furthermore, each argument or claim should be adequately documented with appropriate bibliographic references, as this particular professor is demanding and places particular emphasis on theoretical documentation and methodological accuracy. Should further clarification or guidance be required regarding the choice of theory, crime, or the structure of the paper, I am at your disposal. Thank you!

Make sure your support your response with legal reasoning using the Model Penal Code. use APA format for your citations Tony and Michelle are young and in love, but both are out of work and drowning in bills, but still decided to get married and let love conquer all. Tony, knowing he had no money, still told Michelle he was going to buy her an engagement ring. Michelle inquired how he could afford it and he told her not to worry about it. The couple went to Kay’s Jewelry store and Michelle picked out the ring of her dreams, which cost $10,000.00. Tony paid in cash and Michelle could not understand how he got the money but said nothing. They left the store with the ring, and Michelle began sending her friends pictures of it and posting photos on social media. Later that night, Michelle did ask where Tony got the money for the ring. He responded with a kiss and told her not to worry about it. They went to the courthouse and got married the next day at the Justice of the Peace. After the ceremony they decided to go to the local bar and drink to their wedded bliss. While at the bar, several friends purchased multiple rounds of shots for them and congratulating the newlywed couple. Tony and Michelle drank too much to the point, the bartender Mikey, refused to serve both of them anymore drinks. An argument ensued and Tony pulled out a gun from his pocket and fired a single shot which grazed Mikey’s arm, ricocheted and killed Melinda, another bartender, who was standing behind Mikey. Tony grabbed Michelle and left the bar. The next day when they woke up, Michelle realized what Tony had done and insisted that he turned himself into the police. Tony drove to his friend Timmy’s apartment to hide the gun while Timmy was at work. Michelle decided she loved Tony too much to turn him in. She decided not to say anything to anyone and live happily ever after with Tony. Someone knocked on the door, when Michelle answered it, it was the bartender, Mickey. He begged Michelle to go to the police department and tell the police what happened. Michelle agreed to go with Mickey. While on the way to the police department with Mickey, Michelle had a change of heart and told Mickey, love conquers all and she could not tell the police what happened. Michelle took a hammer from her purse and began hitting Mickey in the head multiple times, the car went off the road in a ditch. When law enforcement, the fire department and the ambulance and emergency medical technicians arrived, Mickey was dead, and Michelle was passed out. When she awoke in the ambulance, she told the EMT she does not remember what happened, she had blacked out. Michelle and Tony were both arrested shortly thereafter.

We have discussed the elements needed for a crime, actus rea and mens rea. But proving intent can be challenging. Getting into the mind of a person is difficult; how can you prove what the person was thinking or the intent at the time of the crime? Answer the following: 1) There are many cases in which an individual has been convicted on circumstantial evidence for the crime of murder. Find a recent (past 5 years) and local case in your home state in which a person has been found guilty of murder or a varied degree of homicide. Summarize the case in your main post. Indicate the reasons for the conviction. Was it based on physical or circumstantial evidence? What did the prosecutor use to prove the mental intent of the offender at the time of the crime? 2) Did the prosecution and/or the defense use legal technology in some way to aid in the development and/or presentation of their respective sides of the case? Was that use (if any) actually helpful in that case (or potentially, other similar cases)? If it was not helpful, explain why you think so. 3) Do you agree with the outcome of the case? Discuss why.

  • Law Question

Tort law ensures that if one party harms another through intentional actions, negligence, or strict liabilitysuch as with defective productsthe aggrieved party can seek restitution to be made whole. Strict liability applies when a product is inherently unsafe, requiring no proof of intent or negligence. In civil cases, the court determines appropriate damages to restore the injured party to their prior state, often through financial compensation since the wrongful act cannot be undone. Some torts, like assault, may also constitute crimes, but the focus here is on civil remedies.

Understanding tort law is essential for businesses as it addresses civil wrongs like negligence and product liability, which can have significant financial and reputational impacts. This legal framework helps professionals minimize risks, implement safety measures, and navigate disputes effectively. For instance, a product manager must consider potential liability if a consumer good causes harm. By understanding tort law, businesses can mitigate risks, comply with legal standards, and protect themselves from costly lawsuits, safeguarding both their operations and market position.

In Assessment 3, you will explore a tort case involving negligence or product liability, analyzing how the court reached its decision and how the ruling could impact business practices. You are also encouraged to perform the ungraded knowledge check activity to gauge your readiness before completing the assessment. These activities will help you understand the broader implications of tort law and its practical application in preventing harm, protecting business interests, and shaping industry standards.

Once you have selected a business-related case involving tort law and an organization impacted by the decision, assume youre a senior manager in the organization you selected and that you were asked to prepare a briefing (34 double-spaced pages) of the court decision to help the executive team of the organization understand the impact the case might have on the company.

In your briefing, please complete the following:

    1. Summarize the facts of the case.
      • Include detailed explanations of the facts.
      • Include key distinctions and nuances that enhance understanding of the case.
    2. Analyze all relevant tort(s) and the elements required to prove each.
      • Provide detailed explanations of their significance and relevance.
      • Explain how these torts and the associated elements matter in the case.
    3. Evaluate the strengths and weaknesses of each partys arguments.
      • Provide insightful and nuanced analyses of each party’s arguments.
    4. Analyze the courts ruling and rationale clearly and accurately.
      • Offer detailed commentary on the rationale and implications.
    5. Explain accurately how the ruling applies to a specific industry and third-party company.
      • This is the company and industry where you should imagine yourself to be a senior manager for this assessment.
      • It is for the real or imagined executives of this company that you write this briefing.
      • Provide these executives with concrete examples to demonstrate how they should modify their their operating procedures to be consistent with the case opinion.

    Requirements: 3-4 pages double spaced
