  • Unit 9 Assignment – ADR

    Loria Pitchfork thinks Jay Pitchfork needs a special tool to do his handyman work around the house they just purchased. She finds a somewhat unique-looking small handheld saw with multiple blades that looks like just the right tool, buys it, and presents it to him on his birthday. It is manufactured and sold online by Big Business Modern Tools, a huge online rival to big box stores such as Home Depot, carrying thousands of tools for the home fixer up types and selling millions of units per year. Jay is ecstatic and immediately opens it up, reads the very simple first page on how to use it, and does not look at the next three pages. He is at their new house doing some small repairs, and while using the saw to do an ordinary cut, the blade jumps free, even though he has securely attached it per the instructions that came with it, slicing deep into his hand. He wraps it and rushes to the local hospital, where he is stitched up. Distraught, Jay comes to you, his trusty attorney, and wants to pursue a claim for damages because of the injury he received. He lives in North Carolina and has heard great things about court-ordered arbitration as a quick way to resolve a claim without having to wait for trial. Additionally, in his haste to get to the hospital to get stiches to stop the bleeding, he left the saw plugged in, and it overheated, causing a fire that burned down his house (which was not insured because he just moved in). However, as you begin to review the instruction manual to make sure Jay did attach and use the saw correctly, you quickly see that beginning on page 2, there is a mandatory arbitration agreement wherein the buyer agrees that states: All claims and disputes arising under or relating to this Agreement are to be settled by a private binding arbitration. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall be conducted by a private arbitrator selected by the seller and awards are to be limited to loss of the value of the saw. Jay is outraged and insists that it is not fair, should not be legal, and cannot believe the courts would enforce such an agreement. He also wants to know which type of arbitration would favor him and why? Research the applicable law as stated for court-ordered arbitration in North Carolina and private arbitration agreements in consumer purchases and advise him which applies. Please give him your opinion on why or why not each is enforceable. In the case of the private arbitration agreement, if there are loopholes or legal precedents to avoid it and proceed via the North Carolina arbitration statute. Be sure to cite applicable case law and statutes supporting your position. Be sure to: List the requirements and procedures for both court and private arbitration. Compare the advantages to Jay in using either court or private arbitration in this case. Distinguish which form of arbitration can be used in this case. Analyze the existing case law governing whether a binding consumer arbitration agreement is enforceable in this scenario. In addition to fulfilling the specifics of the assignment, a successful paper must also meet the following criteria: Include a cover page and references page in 10- to 12-point font (Arial, Courier, and Times New Roman are acceptable). Viewpoint and purpose should be clearly established and sustained. Assignment should follow the conventions of Standard English (correct grammar, punctuation, etc.). Writing should be well-ordered, logical and unified, as well as original and insightful. Your work should display superior content, organization, style, and mechanics. Appropriate citation style should be followed. You should also make sure to: Include a title page with full name, class name, section number, and date. Include an introductory and concluding paragraph and demonstrate college-level communication through the composition of original materials in Standard English. Use examples to support your discussion. Cite all sources on a separate reference page at the end of your paper and cite within the body of your paper using APA format and citation style.

    In this assignment, write a brief paper that details the organization, training audience and task analysis. Your submission should be at least 2 pages and no more than 5 pages long. Make sure to include an introduction and conclusion. Remember to include outside resources to support your argument in this assignment. This paper is the first part of your assignment (project). Please note that a well-done needs analysis will make writing the remainder of the project much easier. Organization Analysis Name of the organization (an actual organization). Describe what the organization does, produces, manufactures, or the services they offer. Describe the organizations primary business strategy; select which of Noes strategies it aligns with (Noe, Chapter 2). Describe how your proposed program will support that strategy. Audience Analysis (also called Person Analysis) Identify your training audience. Select and perform two needs assessment techniques/data collection methods to gather data about your audience (Noe, Chapter 3). Identify and explain person characteristics in 5 areas of importance to your audience. Several person characteristics areas are listed in the Noe text; however, you can use any that make sense for your situation.     I am asking you to cover the following in your response paper:

    1) Nuts & Bolts who are the authors, designers, characters, and overall plot and design aesthetic.

    1. Dont spend too much time on this section.

    2) Connect the relationship between artistic elements (music, lyrics, choreography, sets, costumes, lights) and the dramatic ones (plot, story, character arcs).

    1. How do these different areas affect your experience? Do they help to tell the story? How so?
    2. What areas of production work well together? What areas do not, if any?

    This level of decoding asks you to deconstruct the elements above and their relationships to each another as well as their position within the larger context of the shows narrative, historical timeline, etc. Some of the older shows might feel outdated in 2025. Think back to the culture in the decade they premiered. What was going on in American history at that time? You may find some of them were more groundbreaking than you thought!

    Preparation:

    • Do your background research on the who, what, when, where (this should be straightforward).
    • Also include the historical reference what was happening in the world when this came out?
    • Is there any connection here?
    • Plan to watch the film twice.
    • Try to focus on individual elements each time, it will help you take better notes.
    • This takes more time, but I know you will find new information the second time you watch.
    • Write notes as you watch, both detailed and summary, one-word or phrased thoughts. Pause the movie as needed to do this. Think free association. Dont censor your note-taking or get caught in writing a novel.
    • Once you finish the film, spend some time going through your notes while everything is fresh in your mind.
    • DO NOT WAIT TO DO THIS.
    • Begin to unpack what you wrote down and connect them to your other notes/research.

    Make a plan to watch the film again and repeat the above steps, looking for new clues you didnt catch the first time.

    Response papers should not exceed one page in length. On Canvas, this translates to approximately 500 words. You may find it easier to write in another software (Google Doc, Microsoft Word) and then transfer your assignment to Canvas.

    Papers should follow the same style guidelines as your Discussion Board postings, meaning spelling, language, cogency, and development all count here. Citations should be used when appropriate. Submit directly through Canvas.

    1. WHY do these characters speak/look/act the way they do?
    2. How do the music and lyrics reflect the dramatic action in particular scenes and as a whole throughout the movie? Are they specific to a character or a larger theme or idea about the plot?
    3. Is the text/music aggressive or sweet to evoke a sensibility? Does the music indicate to you when something is about to happen or just happened?
    4. In what ways do specific songs help to construct the arc of a characters story as well as the musical as a whole?
    5. How do the different design elements work together (sets, costumes, lighting, etc.) to create a convincing aesthetic? What doesnt work?
    6. Describe the way that the story is told and portrayed given the year in which it premiered. What was happening in history during the time and how do the two connect or reject one another?

    You will not answer EVERY question on the worksheet above, but use these as a starting point to understand why certain choices were made to enhance the story being told in music & lyrics or other design areas.
