1. What is the significance of the Supreme Court’s 1803 Marbury v. Madison decision?

What was the case about, and how did the Courts decision help to clarify the specific
powers that it exercised? What can the Supreme Court do? How does it play a key role in
a system of checks and balances?

2. In Federalist 70, Alexander Hamilton argues for the necessity of an Executive Branch in

the new constitutional scheme. Discuss his argument: Why, for example, does he claim
that a president will bring “energy” to government? In what specific areas of governance
will such energy be important? And what does he mean when he argues that the

Executive should be a unitary one? Why would it be problematic to have more than
one person in this role?

expanded on the Constitutions civil rights protections.

Bonus (2 points): Our textbook discusses the “classic legislative process” and argues that

“modern legislation is different.” Discuss some of the reasons why the legislative process has

including some direct quotes.
