Paralegal: Retainer Fee Agreement

We have learned the need for a Retainer Agreement in legal representation. The agreement defines the relationship between an attorney and a client, including the scope of services, fee arrangements, client responsibilities, and termination of the agreement.

Objectives

Upon completion of this assignment, students will demonstrate an ability to

  1. Draft a professional agreement that outlines the legal services provided, ensuring clarity and specificity in legal representation.
  2. Follow complex instructions and submit independent work in a timely and professional manner.

Instructions

For this assignment, you will draft a Retainer Agreement. I am your client. Assume that I have hired you to handle a specific legal matter. Clearly define the scope of services, detailing what you will and will not do. Be creative on why I have hired your firm.

Determine whether you will charge an hourly rate, a flat fee, or a contingency fee. Be sure to include billing practices, retainer deposits, and any additional costs I might incur, if any. You will be submitting timesheets a few more times throughout the course, so I recommend an hourly retainer agreement.

I have provided a few samples you may use as a template.

You will create your own law firm name, establish a fee structure, and define the legal services to be provided. Feel free to be creative – you are not limited to the samples linked below. You may use any resources you wish, including online searches, CEB, and Lexis resources.
