Local jails play an important role in the correctional system and often serve as the first point of confinement after an arrest. Individuals may be held in jail while awaiting trial, serving short sentences, or being detained for probation violations. One of the most challenging decisions within the jail system is determining whether an individual should remain in custody or be released under supervision while their case moves through the court process. These decisions involve evaluating several factors including public safety, the seriousness of the offense, the risk of failing to appear in court, and the offenders criminal history. Judges, jail administrators, and other justice system professionals may view these situations differently depending on their responsibilities and priorities. In this discussion, you will examine a detention decision and defend a recommendation from a specific professional perspective. This activity will help illustrate the complex factors that influence jail detention decisions.
Prepare for this discussion by reviewing and completing the embedded activities in:
Part I – Your Initial Post:
Your original response is due by Thursday of the module at 11:59 p.m.
-
- Your original response should be at least 250 words.
- Select one of the sentencing scenarios below.
- You must support your response with at least one source from the course materials, using an APA-formatted in-text citation(s) and a reference section in APA format. (Hint: you can cite your textbook.)
Scenario:
During a late evening traffic stop, police officers stopped a vehicle for running a red light. The driver, Marcus Lee, age 27, appeared nervous during the stop. Officers discovered that Marcus had an active probation status from a prior theft conviction. During a search of the vehicle, officers located several items that had been reported stolen earlier that evening from parked vehicles in the area.
Marcus denied involvement in the thefts but admitted that the property belonged to a friend who had been riding in the car earlier in the evening. Because Marcus was on probation and may have violated probation conditions, he was arrested and booked into the county jail.
The court must now determine whether Marcus should remain detained in jail or be released under supervision while the case proceeds.
For this discussion, you will select one of the four perspectives below.
Perspective 1: Public Safety Priority
From this perspective, detention decisions should prioritize community safety.
In your response:
What risk factors justify detention in this case?
How might releasing Marcus create risks for the community?
Part II – Peer Response Criteria:
You must respond to at least two peers by Sunday of the Module by 11:59 p.m.
- Peer responses should be to peers who selected other initial prompts than the one you chose.
- Peer responses should be at least 150 words.
- Structured Peer Responses Should:
- Identify one factor they used to support their detention decision.
- Explain whether you agree or disagree with their reasoning.
- All references should be cited and listed in a reference section in APA format.
- You are expected to participate on a minimum of two days each module.
